Why Was Ball-Play in the Park Tolerated even though It Was Banned as a Nuisance to Others?: The Case of a Park Project in Funabashi City, Chiba, Japan.

公園は開かれた公共空間である。そのため公園は、本来、誰でも自由に利用可能であるべきと思われる。それにもかかわらず、公園でのボール遊びは禁止される場合が多い。しかし、地方自治体の一部では、公園で制限されていたボール遊びが容認されていることが知られている。本研究は、千葉県船橋市を対象とし、船橋市において他人の迷惑になるボール遊びが禁止されていた理由を明らかにするとともに、「他人の迷惑になるボール遊びは禁止」とされていた状況から公園でのボール遊びが容認されるに至った理由を明らかにすることを目的とする。本研究の結果は以下の通りである。１）公園にかかわる関係者における自由の競合は公園でのボール遊びに内包されていた。２）船橋市において他人の迷惑になるボール遊びが禁止されてきた理由は、公園ニーズの多様化、公園の物理的な特徴の不十分さ、そして、誰にとっても安心であるべきという行政の方針、があった。３）船橋市の事業は、公園にかかわる関係者における自由の競合を調整する取り組みであった。４）船橋市の事業が開始された理由として、公園でのボール遊びを求める中学生からの提案を船橋市の政策に直接反映させる仕組みが存在した。５）船橋市の事業では、公園でのボール遊びについて近隣から理解を得られることが優先された。６）船橋市の事業では、公園でのボール遊びの実現のために、全ての関係者から正しく理解されやすく分かりやすいルールが新たに導入された。７）船橋市の事業では、公園でのボール遊びの実現のために、一部の公園が「ボール遊びができる施設」として指定された。８）船橋市の事業には、公園にかかわる関係者における自由の競合を調整する基本的な方針として「試行錯誤」があった。
[ Abstract ]
The park is an open public space and should be available to everyone for outdoor recreation. However, there are a lot of parks in Japan that prohibit ball-play. Conversely, some municipal governments have tolerated ball-play in parks. The object of this study is to clarify the reasons for both the prohibition of ball-play and allowance of ball-play, in Funabashi City, Chiba Japan. The findings show that ball-play which is a nuisance to others in the parks includes conflict among stakeholders. Further, the reasons why ball-play was prohibited in Funabashi City, Japan was the need for diversification of the parks, insufficient physical characteristics, and an administrative policy where the park should be safe for everyone. The Park Project of Funabashi City aimed at resolving the conflict among stakeholders. This started with a proposal presented by junior high school students seeking approval for ball-play in the parks to the Funabashi City Office. In the Park Project of Funabashi City, permission from neighbourhood residents about ball-play in the parks was given priority and clear rules which was understood by every stakeholder were introduced to allow ball-play in the parks. A part of the park was designated as "facilities available to play with balls." Finally, in the Park Project of Funabashi City, trial-and-error was essential in coordinating the conflict among stakeholders.
